Welcome to WPDesigns. These Terms of Service ("Terms") govern your access to and use of our web design services, client onboarding platform, and related services (collectively, the "Services").

By accessing or using our Services, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Services.

2. Description of Services

WPDesigns provides web design services including but not limited to:

• Client onboarding and requirements gathering
• AI-assisted homepage mockup generation
• Custom website design and development
• Website maintenance and support services
• SEO and digital marketing services
• Project management and collaboration tools

3. User Accounts

When you create an account or submit information through our onboarding form, you agree to:

• Provide accurate, current, and complete information
• Maintain and update your information as needed
• Keep your account credentials confidential
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access

4. Project Process

4.1 Onboarding

Our onboarding process collects your project requirements, design preferences, and business information. This information is used to generate initial mockups and create project documentation.

4.2 Mockup Generation

We use AI technology to generate initial homepage mockups based on your requirements. These mockups are starting points for design discussions and may require revisions.

4.3 Revisions

The number of revisions included depends on your service package. Additional revisions may incur extra charges as outlined in your project agreement.

4.4 Approval and Delivery

Final designs require your written approval before development begins. Delivery timelines are estimates and may vary based on project complexity and revision requests.

5. Payment Terms

Payment terms are specified in your individual project agreement or Statement of Work (SOW). General terms include:

• A deposit is required before work begins
• Milestone payments may be required for larger projects
• Final payment is due upon project completion
• Late payments may incur additional fees
• All fees are non-refundable unless otherwise specified

6. Intellectual Property

6.1 Your Content

You retain ownership of all content, logos, images, and materials you provide to us. By submitting content, you grant us a license to use it for the purpose of providing our Services.

6.2 Our Work

Upon full payment, you receive ownership of the final deliverables created specifically for your project. We retain the right to:

• Display the work in our portfolio
• Use the work for marketing and promotional purposes
• Retain ownership of any proprietary tools, frameworks, or templates used

6.3 Third-Party Assets

Some projects may include third-party assets (stock images, fonts, plugins) which are subject to their own licensing terms.

7. Acceptable Use

You agree not to use our Services to:

• Violate any applicable laws or regulations
• Infringe on intellectual property rights of others
• Submit false or misleading information
• Transmit harmful code or malware
• Interfere with the operation of our Services
• Create websites promoting illegal activities, hate speech, or adult content

8. Limitation of Liability

To the maximum extent permitted by law:

• Our Services are provided "as is" without warranties of any kind
• We are not liable for any indirect, incidental, or consequential damages
• Our total liability shall not exceed the amount paid for the specific service
• We are not responsible for third-party services or integrations

9. Indemnification

You agree to indemnify and hold harmless WPDesigns, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of our Services, your violation of these Terms, or your violation of any rights of a third party.

10. Termination

Either party may terminate the service relationship:

• With written notice as specified in the project agreement
• Immediately if the other party breaches these Terms
• Payment for work completed up to termination date is required

Upon termination, your access to project files and the Client Hub may be revoked.

11. Dispute Resolution

Any disputes arising from these Terms or our Services shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with applicable laws.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by posting the updated Terms on our website. Your continued use of our Services after changes constitutes acceptance of the modified Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which WPDesigns operates, without regard to its conflict of law provisions.
